It seems that the judge found that Diez’s prior military service and testimony from his former co-workers were mitigating factors and that dropped his sentence down. Now before you think he got off easy, he was fined $1,200 to pay medical costs for his victim’s broken eardrum and he’ll have to attend anger-management classes.
Sheesh.
Our court system has gone to hell in a handbasket. Part of Virginia’s problem is the General Assembly legislating light sentences through sentencing guidelines. These guidelines tie the hands of already liberal judges. Add to that the constant wheeling and dealing of attorneys and you get defendents pleading guilty to one charge if he/she can get another one dropped and do minimal or no jail time. Prison time is almost unheard of nowadays, and cops arrest the same a*sholes again and again. Whatever happened to the 3 time loser deal? If your criminal record reads like a Tolkien novel and you’re still walking the street, there’s a real problem here.
This state’s court system needs an enema.
